Despite the recent executive order signed by the President of the United States, Donald Trump, the cannabis market in the country continues to operate without federal legalization. The measure, announced in December, does not change the legal status of the plant at the national level, nor does it promote broad decriminalization of use or interstate commerce, as highlighted by the Cañamo portal.


The order instructs federal agencies to expedite the process of reclassifying cannabis in the Controlled Substances Act, with the possible change from Schedule I, reserved for drugs with no recognized medicinal value, to Schedule III, where substances with accepted medical use and lower potential for abuse are listed.

Reclassification does not equal legalization


In practice, the change may facilitate scientific research, reduce regulatory barriers, and mitigate fiscal impacts on sector companies. However, it does not represent federal legalization, nor does it authorize interstate commerce or recreational use under national legislation.


Cannabis remains prohibited at the federal level, maintaining significant restrictions, especially in access to banking services, institutional investments, and large-scale financial operations.


Market Continues Dependent on State Laws


With dozens of states already adopting their own laws for medicinal and recreational use, the United States continues in a fragmented model, where the cannabis market grows but operates in a hybrid legal environment. 


According to experts interviewed by Cañamo, only legislation approved by Congress could establish unified rules and ensure full legal security to the sector. Meanwhile, the industry continues to operate under state regulations, awaiting a more comprehensive federal definition.
