In the episode #47 of Deusa Cast, lawyer and columnist for Portal Sechat, Carla Coutinho provided valuable guidance for those who use cannabis therapeutically and need to travel. The cannabis law specialist emphasized that transporting cannabis oil, as long as accompanied by a medical prescription, is permitted within the national territory.
“If you are using oil and have a medical prescription, I see no problem. Go ahead, because you are not doing anything wrong; you are taking care of your health and your fundamental right,” advised the lawyer.

On the other hand, transporting flowers or seeds, even with a prescription, is still considered risky in Brazil. Carla explains that without a safe conduct (judicial authorization obtained via Habeas Corpus), it is likely that the substance will be seized during inspections at airports. “I do not advise you to travel with flowers, even within Brazil. I think it is risky and precarious because the police protocol is very strict. Until you explain, you could miss your flight and go through unnecessary embarrassment,” she warned.
What about international travel?
Attention should be doubled. Each country has its own rules regarding the use and transport of medical cannabis, and being unaware of them can lead to serious legal issues.
“It is important to understand the legislation of the destination country. In places like Portugal or the United States, for example, you cannot bring cannabis, even with a prescription. However, in the opposite direction, from Portugal to Brazil, if there is a safe conduct and prescription, I see no problem,” Carla explained.
The lawyer emphasizes that the ideal is to consult local legislation and avoid transporting any cannabis product without legal support.
