Anvisa appeals, and injunction guaranteeing Apepi to produce Medicinal Cannabis should fall

Lawyer Margarete Santos de Brito and her husband, Marcos Lins Langenbach, used a social network tonight (16) to communicate that the injunction guaranteeing Apepi (Association of Support for Research and Patients of Medicinal Cannabis) the right to "research, plant, harvest, cultivate, manipulate, transport, extract oil, package, package, and distribute to members the extract of cannabidiol, derived from Cannabis", is expected to be revoked. The decision, which can be appealed, is expected to be published in the next few hours. 

According to the couple, last Friday (13), Anvisa (National Health Surveillance Agency) appealed the injunction that had been granted by the 4th Federal Court of Rio de Janeiro on July 15. "Despite the Rapporteur Judge Vera Lucia Lima voting in favor of maintaining the injunction, Judge Guilherme Diefenthaeler decided to revoke it, and Judge Marcelo Pereira da Silva followed his vote and the majority was formed," the entity said in a statement. 

According to Apepi, the decision that allowed associative cultivation on a large scale was granted by the Justice with a series of restrictions and requirements. "A historic Yes that put us in another dimension within what we propose to do, a dynamic that is daunting in the face of numerous challenges," said the leaders. "Whether for budgetary, structural, security, and quality of life issues for those who have undertaken this endeavor."

The decision has not yet been published.

"The work here cannot stop," said the trio. Ironically, on Saturday the 14th, it was the day to make the first plants bloom. Double work, inauguration of the flowering plateau, assembly of a new greenhouse: we worked hard until 8 pm. The plants are indifferent to the injunction... Of course, there is the fear of being at the forefront of a cultivation that is legal and runs the risk of being turned into illegal due to ideological reasons. But where fear tries to disturb, the certainty of the well-being of several people directly associated with our work here, calms.
