Brazilian states ensure free access to cannabis through SUS

At least 15 governments have already adopted measures to distribute these medicines in Brazil

The Brazilian scenario is witnessing a significant advancement in the regulation of the medicinal use of cannabis, with at least 15 states already approving laws that enable the free distribution of these medicines by the Unified Health System (SUS). Joining this initiative, São Paulo published in December 2023 the regulation of its law aimed at providing cannabis-based medicines.

In addition to São Paulo, 14 other states have already taken this pioneering path, namely:  

> Acre; 

> Alagoas; 

> Amapá; 

> Distrito Federal; 

> Espírito Santo; 

> Goiás; 

> Mato Grosso; 

> Paraná; 

> Piauí; 

> Rio de Janeiro; 

> Rio Grande do Norte; 

> Rondônia; 

> Roraima and; 

> Tocantins  

It is worth noting that the regulation establishes fundamental requirements for the prescription and distribution of these medicines. Cannabis-based products must have certification registration with the National Health Surveillance Agency (Anvisa), ensuring quality and safety standards. In addition, interested parties must present a medical prescription justifying the need for treatment with cannabis. 

The effectiveness of cannabis in treating various diseases is remarkable, covering conditions such as refractory epilepsy, chronic pain, Alzheimer's, anxiety, Parkinson's, among others. Patients generally use oils, ointments, extracts, or medications developed from substances present in marijuana, some of which are already available in pharmacies. 

However, it is important to remember that despite the progress in medicinal use, adult consumption of cannabis remains prohibited in Brazil. The use of the plant for smoking or ingesting, whether in cigarettes or mixed with food, still lacks legal regulation. In parallel, the Supreme Federal Court (STF) is discussing the possibility of releasing possession for personal consumption, signaling a constantly evolving scenario in the Brazilian legislation approach to cannabis.
