The Florida Supreme Court has received a request from the state's attorney general, James Uthmeier, to review a new initiative that aims to legalize adult use of cannabis and put it to a vote in the 2026 elections. 


According to Marijuana Moment, the request initiates the constitutional analysis process required for amendment proposals submitted through a popular petition.


The measure is led by the Smart & Safe Florida committee, the same group responsible for the legalization proposal submitted to voters in 2024. Although it garnered the majority of votes, the previous initiative did not reach the minimum 60% approval required by the state constitution for amendments.


Legal analysis and inquiries


The attorney general's request does not address the merits of legalization itself, but rather the clarity of the text and the proposal's conformity with Florida's constitutional rules. The Supreme Court will assess whether the wording presented to voters meets the legal criteria for popular initiatives.


According to the timeline set by the court, the state and proponents of the proposal will need to present their arguments in writing in the coming months. It is expected that the case will progress to formal discussion in early 2026, prior to a decision on the inclusion of the measure on the ballot.


Path to the ballot


The campaign organizers claim to have already collected over a million signatures, a sufficient number to advance the process, despite challenges related to the validation of some of these supports. The group has resorted to the courts to contest administrative delays in the proposal's processing.


If the Supreme Court deems that the initiative meets all legal requirements, the proposal could be resubmitted to the popular vote in 2026, keeping the debate on cannabis legalization on the agenda in Florida's political landscape.
