US lawmakers seek to authorize the commercialization of hemp and CBD as dietary supplements

A bipartisan group of lawmakers in the United States Congress reintroduced a bill on Thursday (4). The proposal would allow hemp and CBD derived from the crop to be marketed and sold as dietary supplements.
The Consumer Protection and Market Stabilization Act for CBD and Hemp is the third piece of cannabis legislation to be introduced so far in the new 117th Congress, which was recently installed. Primarily, the law would provide critical regulatory clarity to the hemp industry as federal agencies develop rules for CBD marketing.
According to the proposal by Representatives Kurt Schrader (D-OR) and Morgan Griffith (R-VA), who introduced an identical bill last year, "hemp, hemp-derived cannabidiol, and any other hemp-derived ingredient will be allowed for use under the Federal Food, Drug, and Cosmetic Act as a dietary ingredient."
The bipartisan duo also have 17 other original cosponsors signed onto the latest version of the legislation.

Lawmakers have been pressuring the Food and Drug Administration (FDA), the regulatory agency equivalent to Anvisa in Brazil, to adopt regulations that establish this type of marketing. This is because hemp was legalized by the federal government under the 2018 Farm Bill. However, the agency has so far only offered guidance on discretion for the application of these products while continuing to develop formal rules.
Other important FDA decisions happened last month
Last month, the FDA withdrew the guidance document on CBD application that it had submitted for White House review in 2020. There are few details on what the proposal included, but it was expected to give the industry a better understanding from a federal perspective when it comes to marketing cannabis products.

The agency was required under the appropriations legislation enacted in 2019 to provide an update on its regulatory approach to CBD. It did so in March of last year. The update stated that “FDA is currently evaluating the issuance of a risk-based enforcement policy that would provide greater transparency and clarity regarding the factors the FDA intends to take into account in prioritizing enforcement decisions”.
