Government has five days to comment on regulation of cannabis cultivation, determined by STJ

Minister Regina Helena Costa, from the Superior Court of Justice (STJ), summoned the Union and the National Health Surveillance Agency (Anvisa) to comment on the progress of the regulation of cannabis cultivation with low THC content for medicinal purposes. The determination is part of the Action Plan aimed at implementing the measure, with a deadline until September 30 of this year.

In the order signed on August 1, the judge requested that the federal agencies inform, within five days, the status of the execution of the stages provided in the official schedule.

“The Union and Anvisa must, by then, inform this Court about the execution of the intermediate stages detailed in the schedule,” wrote the minister.

 

Ordinance paves the way for regulation

 

Prior to the summons, on July 30, the Ministry of Agriculture and Livestock (Mapa) published Ordinance SDA/MAPA No. 1,342, which establishes phytosanitary requirements for the importation of Cannabis sativa seeds, regardless of the country of origin.

The measure represents progress in the process of regulating cannabis cultivation in Brazil. According to the ordinance, imported seeds must be accompanied by a Phytosanitary Certificate issued by the exporting country. The document must contain additional declarations attesting to the absence of specific pests, such as Grapholita delineana and Ditylenchus dipsaci, among others.

The norm also details phytosanitary inspection procedures and other technical requirements applicable to the process.

The Sechat Portal contacted the Union and Anvisa and until the publication of this article (08/05/2025, at 10 am) did not receive a response.
