STJ defines September 30, 2025 as the date for regulating cannabis cultivation in Brazil
After receiving the Union's action plan, the 1st Section of the STJ extends the deadline for the delivery of regulations on the production and access to cannabis for medicinal use
The 1st Section of the Superior Court of Justice (STJ) approved, on Wednesday (11), the action plan presented by the Union for the regulation of cannabis cultivation for exclusively medicinal purposes. With a unanimous decision, the new deadline set for the delivery of regulations is September 30, 2025.
The action plan was filed on May 19 and, in addition to the request for an extension of the deadline, proposes integrated measures to regulate all stages of the productive chain from cultivation and production of cannabis derivatives to the therapeutic use of plant-based medications.
By the new deadline, the Union and the National Health Surveillance Agency (Anvisa) must update the STJ on the progress of the intermediate stages described in the schedule.
Partial efforts justify new deadline
The new deadline was granted considering that the Union, Anvisa, and the Ministry of Health demonstrated commitment to complying with the previous court order — even if still incomplete.
As the rapporteur of the special appeal that determined the regulation of medicinal marijuana, Minister Regina Helena Costa assessed that, given the actions initiated by the responsible agencies, it was reasonable to grant an extension in the deadline for the completion of the process.
