Government publishes rules for the importation of Cannabis sativa seeds

New ordinance from MAPA defines requirements for the importation of Cannabis sativa seeds, focusing on phytosanitary safety and the advancement of hemp regulation in the country

The Ministry of Agriculture and Livestock (MAPA) published, on Wednesday (07/30), the Ordinance SDA/MAPA No. 1,342, which establishes phytosanitary requirements for the importation of Cannabis sativa seeds, regardless of origin. The regulation comes into effect on the date of its publication and is part of the Federal Government Action Plan to regulate hemp cultivation in Brazil, with a final deadline set for September 30, 2025.

The regulation stipulates that imported Cannabis sativa seeds must be accompanied by a Phytosanitary Certificate issued by the country of origin. This certificate must contain additional declarations proving the absence of specific pests, such as Grapholita delineana and Ditylenchus dipsaci, among others.

Furthermore, phytosanitary inspection is required upon the product's entry into Brazil, with sample collection for laboratory analysis. The costs of these analyses will be the responsibility of the importer.

If quarantine pests are identified during the inspection, the shipment may be destroyed or rejected. In this situation, the country of origin risks having its imports temporarily suspended. The ordinance also emphasizes that compliance with these phytosanitary requirements does not exempt the need to adhere to other legal norms related to Cannabis sativa.

 

Public consultation on medicinal derivatives continues until August

 

In parallel, the Action Plan provides, until August 15, a deadline for directive consultation with specialists and public dialogue sessions, organized by the Ministry of Health and other involved entities. Recently, representative associations visited Minister Carlos Fávaro, who expressed support for the agenda.

According to the Plan, this stage aims to expand the technical version of the draft Ordinance on the regulation and oversight of the production and access to Cannabis derivatives for exclusively medicinal use.
