STJ schedules trial on Government deadline and creation of 'Regulatory Sandbox' for cannabis

On Thursday, November 6, 2025, the First Section of the Superior Court of Justice (STJ) will judge two crucial petitions related to Special Appeal (REsp) 2024250/PR. The case deals with the regulation of industrial hemp cultivation in the country.

The session, which will begin at 2 p.m., with live streaming on YouTube, is under the responsibility of Minister Regina Helena Costa, the case's rapporteur. The minister now brings to the Section's vote requests that could define the sector's immediate future.

According to the procedural movement, the ministers will analyze two central points. The first is the Union's request for an extension, which asked the STJ for a new 180-day extension to present the cannabis cultivation regulation. The original deadline of September 30, 2025, expired without a definition from the Government.

The second is the DNA Biotechnology Solutions' request for an exclusive 'regulatory sandbox'. In practice, it would be a temporary and controlled permission, allowing cannabis cultivation on Brazilian soil while the definitive cannabis regulation is not published.

Coincidentally, the date of the trial (November 6) coincides with the Cannabis Connection, the main meeting of the medicinal and industrial cannabis market in Latin America. The event takes place on the same day that the future of the raw material will be debated at the STJ.
